Where can a Trademark be Registered?
Within EU member countries, national law implements European Directives so that the law in each jurisdiction is more or less equivalent, the eventual goal being harmonisation of trademark law within the EU.
Certain aspects of law do vary on a country by country basis within the EU, such as the protection for unregistered trademarks within the United Kingdom under the common law tort of ‘passing off’ and the inclusion of provisions relating to Honest Concurrent Use into UK national trade mark law (which have their basis in the 1938 UK legislation rather than the Directive which led to the drafting of the UK Trade Marks Act 1994).
There is also a system known as the Madrid System which applies within European countries and provides a means of streamlining applications on a national level via a single international registration which may have effect in several countries, as designated by the applicant.
EU Trademark Registration
An EU trademark is the only region with its registry covering all 27 countries governed by the EU. Otherwise, an application is required within each country. For this reason, the European Union Trademark (EUTM) registration is the most efficient and cost-effective way to gain exclusive rights to a mark within all 27 EU countries and can offer advantages to brands looking to expand within the EU in the future.
The costs involved in EU Trademark Registration:
- EU Trademark Registration – starting at €2,750 + VAT for an EU Mark for 1 class for 10 years.
- Trademark Name Search – €650 + VAT
- Trademark Logo Search – €900 + VAT
Once registered an EU Trademark is valid for a period of 10 years and can be renewed thereafter.
However, if you register a trademark with intent to use it and do not use it within 5 years of completion of registration it becomes vulnerable. A third party such as a competitor could file a cancellation action against the trademark.
